1. Acceptance of Terms
By accessing or using the Don Diablo website (dondiablo.com), including the Hexagonia membership platform and any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is run by Hexagon HQ B.V., Mauritskade 80, Amsterdam, the Netherlands (registered office: Amsterdam; Chamber of Commerce no. 69392927; RSIN 857857691) (“we”, “us”, “our”). Hexagon HQ B.V. also runs HEXAGON HQ (hexagonhq.com), the record label founded by Don Diablo.
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 16 years of age to create an account or use the Service. By registering, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.
3. User Accounts
To access certain features, including Hexagonia, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Keep your login credentials confidential and not share them with any third party.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activity that occurs under your account.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
4. Hexagonia Membership
4.1 Access. Hexagonia is an invite-only membership platform. Access is granted through valid invite codes. Each registered member receives a limited number of invite codes for personal distribution. Invite codes are non-transferable for commercial purposes and may not be sold, traded, or publicly distributed.
4.2 Membership Tiers. Hexagonia operates on a freemium model. A free tier provides access to core features. We may offer premium tiers or paid subscriptions at any time that unlock additional features, content, or benefits. The availability, pricing, and scope of each tier is determined at our sole discretion and may change over time.
4.3 Changes. We reserve the right to modify, add, or remove features from any membership tier at any time. Certain features that are currently free may become part of a paid tier in the future. We will notify members of significant changes in advance.
5. Payments & Subscriptions
5.1 Paid Services. Certain features or membership tiers may require payment. When paid services are available, the following applies:
- All prices will be clearly displayed before purchase, in euros and inclusive of applicable taxes unless stated otherwise.
- Payments are processed through Stripe or another secure third-party payment processor. By subscribing, you authorize recurring charges to your payment method until you cancel.
- Subscriptions automatically renew at the end of each billing period unless canceled.
5.2 Cancellation. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period.
5.3 Refunds. All payments are non-refundable, except where required by applicable law (e.g., EU consumer protection law provides a 14-day withdrawal right for digital services that have not been fully performed, provided you have not waived this right upon purchase).
5.4 Price Changes. We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use after the price change constitutes acceptance of the new pricing.
6. Intellectual Property
6.1 Ownership. All content on the Service — including but not limited to music, audio recordings, videos, artwork, graphics, text, logos, trademarks, and software — is the exclusive property of Don Diablo, HEXAGON, or their respective licensors and is protected by international copyright, trademark, and intellectual property laws.
6.2 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. This license does not include the right to:
- Download, copy, reproduce, distribute, or share any exclusive music, audio, video, or other protected content from the Service.
- Record, screen-capture, rip, or otherwise extract audio or video content from the Service.
- Use any automated tools, bots, scrapers, or crawlers to access or collect content from the Service.
- Modify, adapt, reverse-engineer, or create derivative works based on any content from the Service.
- Use any content from the Service for commercial purposes, including but not limited to DJ sets, remixes, broadcasts, or public performances, without explicit written permission.
6.3 DMCA / Takedown. If you believe content on the Service infringes your copyright, please contact us at info@dondiablo.com with a detailed description of the alleged infringement.
7. User Content & Conduct
7.1 User Content. You may submit content to the Service through community features (e.g., Transmissions, Community Music, Letterbox). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the Service. Photos and videos you upload through a Moments link are covered by section 17.
7.2 Prohibited Conduct. You agree not to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or discriminatory.
- Impersonate Don Diablo, any artist, team member, or any other person or entity.
- Share or distribute invite codes for commercial gain.
- Spam, flood, or disrupt the community features.
- Attempt to gain unauthorized access to other users' accounts or any restricted areas of the Service.
- Use the Service to distribute malware, viruses, or any other harmful software.
- Violate any applicable local, national, or international law or regulation.
- Share, leak, or redistribute any exclusive or premium content outside the Service.
7.3 Enforcement. We reserve the right to remove any content and suspend or terminate any account that violates these Terms, without prior notice or liability.
8. Guestlist & Events
8.1 Availability. Guestlist spots offered through Hexagonia are allocated on a first come, first served basis and are subject to availability and venue capacity. Once all spots for a show are claimed, no further claims can be made regardless of membership status.
8.2 No Guarantee of Entry. Claiming a guestlist spot does not guarantee entry to the event. Entry remains subject to venue policies, local regulations, capacity limits, and the discretion of venue staff. We are not liable for denied entry for any reason.
8.3 Restrictions. Guestlist spots are personal and non-transferable. They may not be resold, traded, or given to third parties. We reserve the right to void any guestlist claim that has been transferred or misused.
8.4 Modifications. We reserve the right to modify, cancel, or restrict guestlist offerings at any time without prior notice. This includes changing the number of available spots, eligibility criteria, or the frequency of guestlist claims per member.
9. Third-Party Services
The Service may contain links to third-party websites and services (e.g., Spotify, Apple Music, YouTube, Stripe, ticketing platforms). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
11. Limitation of Liability
We are not liable for indirect damage, such as lost profit, or for damage caused by third parties such as ticket partners, streaming services or your mobile provider. This does not apply if the damage is caused by our intent or gross negligence, or where the law doesn't allow us to limit our liability. Nothing in these Terms takes away your rights as a consumer under mandatory law.
12. Indemnification
You agree to indemnify Don Diablo, HEXAGON, and their officers, directors, employees, and agents against claims by others (including reasonable legal costs) caused by your breach of these Terms or by content you uploaded that infringes someone else's rights.
13. Governing Law & Disputes
These Terms are governed by Dutch law. If you are a consumer, this does not take away the protection of the mandatory law of the country where you live. You can take a dispute to the competent court in the Netherlands or where you live; we will only bring a case against you in the court where you live.

14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements.
16. SMS & Text Messaging
16.1 Program. When you sign up for a drop, event, or our updates and provide your mobile number, you consent to receive recurring marketing and informational text messages (SMS) from Don Diablo, and, if the text at sign-up says so (on drop sign-ups from 13 October 2026), from HEXAGON — including drop alerts, event reminders, and news.
If you gave your mobile number on hexagonhq.com and agreed there to receive news, drops and offers from Don Diablo and HEXAGON, you are on the same list: you receive these texts from Don Diablo and from HEXAGON. Don Diablo and HEXAGON share one mailing list, so opting out (16.4) stops texts from both.
16.2 Consent. Consent to receive texts is given by submitting the sign-up form and is not a condition of purchasing any goods or services. The exact disclosure shown at sign-up, the date, and its version are stored as a record of your consent.
16.3 Frequency & cost. Message frequency varies. Message and data rates may apply, depending on your mobile carrier and plan. We are not responsible for any such charges.
16.4 Opt-out. You can cancel at any time by replying STOP to any text message. After you send STOP we send one confirmation and then stop sending marketing texts to that number. Reply START to opt back in. For email, use the unsubscribe link in any email.
16.5 Help. Reply HELP for help, or contact info@dondiablo.com.
16.6 Carriers. Mobile carriers are not liable for delayed or undelivered messages. SMS availability depends on your carrier and region.

17. Fan Uploads (Moments)
After some shows we share a link (dondiablo.com/moments/…) where fans who were there can upload their photos and videos ("Uploads"). This section applies to everything you upload that way. A short summary is shown right above the send button; by sending your Uploads you agree to this section. The exact text shown to you, its version and the date are stored with your Uploads.
17.1 Your licence to us. You keep the copyright in your Uploads. By uploading, you grant Don Diablo and HEXAGON, and the companies they work with, a free (royalty-free), worldwide, perpetual and non-exclusive licence to use your Uploads. This licence may be sublicensed to the parties we work with (such as labels, promoters, agencies, editors, platforms and media partners) and may be transferred to any successor or buyer of all or part of our business or catalogue. Under this licence we may:
- use, copy, store, publish, show and share your Uploads;
- edit them, for example by cutting, cropping, colour grading, slowing down or speeding up;
- combine them with other footage and add music, sound, text, graphics or effects;
- do all of this in any media and format, now known or developed later, including social media, advertising and paid promotion, aftermovies and recaps, our website and apps, press and promotional material.
17.2 Credit and moral rights. We try to credit you with the name or Instagram handle you gave us, but credit is not guaranteed — for example when a format, an edit or an ad does not allow it. To the extent the law allows, you waive your moral rights (personality rights) in your Uploads towards us and the parties we work with, including the right to be named and the right to object to edits or to your Upload being combined with other material. Where such rights cannot be waived, you agree not to invoke them against reasonable use under this licence.
17.3 Your promises. By uploading, you confirm that:
- you took the photo or filmed the video yourself;
- you own the rights in your Upload and are free to grant this licence, and your Upload does not infringe anyone else's rights;
- the people who can be recognised in your Upload are fine with it being shared and used as described here;
- your Upload does not show a recognisable minor unless their parent or guardian agrees;
- your Upload contains nothing illegal, harmful or offensive, and nothing that violates someone's privacy.
If a promise turns out not to be true, section 12 (Indemnification) applies.
17.4 Age. You must be 16 or older to upload.
17.5 No payment. Uploading is voluntary. You do not receive any payment, royalty or other compensation for your Uploads or for their use, including when they are used in advertising or other commercial content.
17.6 Our choice. We may review, refuse or delete any Upload at any time, without giving a reason. We are not obliged to use or publish your Upload.
17.7 Removal. Want an Upload removed — your own, or one in which you can be recognised? Email info@dondiablo.com with the show and a description or screenshot of the photo or video. We will delete it from our storage and not use it in anything new. Content that has already been published may stay online, and we cannot recall posts or copies that others have already shared.
17.8 Music and performance. The music, the show and the performance, and the visuals, stage design and trademarks that can be seen or heard in your Uploads, are not part of your licence to us. They belong to Don Diablo, HEXAGON and/or other rights holders (such as labels, publishers, the venue or the promoter), and uploading does not give you any rights in them.
17.9 Your data. How we handle your email address, the people in your Uploads and the other data we store is explained in our Privacy Policy.
18. Giveaways & Contests
Giveaways and contests we run (for example on Instagram, in a WhatsApp group or on this website) have their own rules, which we publish with each one before it starts. For a giveaway decided by a draw, those rules state at least who runs it, when it runs, the prize and its value, how and when winners are chosen and told, that taking part costs nothing beyond your normal phone or data costs, that under-18s need permission from a parent or guardian, and where to send a complaint. Giveaways on Instagram or other platforms are not sponsored, endorsed or run by those platforms.
