1. Acceptance of Terms

By accessing or using the Don Diablo website (dondiablo.com), including the Hexagonia membership platform and any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by Don Diablo / HEXAGON ("we", "us", "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 16 years of age to create an account or use the Service. By registering, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

3. User Accounts

To access certain features, including Hexagonia, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Keep your login credentials confidential and not share them with any third party.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

4. Hexagonia Membership

4.1 Access. Hexagonia is an invite-only membership platform. Access is granted through valid invite codes. Each registered member receives a limited number of invite codes for personal distribution. Invite codes are non-transferable for commercial purposes and may not be sold, traded, or publicly distributed.

4.2 Membership Tiers. Hexagonia operates on a freemium model. A free tier provides access to core features. We may offer premium tiers or paid subscriptions at any time that unlock additional features, content, or benefits. The availability, pricing, and scope of each tier is determined at our sole discretion and may change over time.

4.3 Changes. We reserve the right to modify, add, or remove features from any membership tier at any time. Certain features that are currently free may become part of a paid tier in the future. We will notify members of significant changes in advance.

5. Payments & Subscriptions

5.1 Paid Services. Certain features or membership tiers may require payment. When paid services are available, the following applies:

• All prices will be clearly displayed before purchase, in euros and inclusive of applicable taxes unless stated otherwise.
• Payments are processed through Stripe or another secure third-party payment processor. By subscribing, you authorize recurring charges to your payment method until you cancel.
• Subscriptions automatically renew at the end of each billing period unless canceled.

5.2 Cancellation. You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds will be issued for unused portions of a billing period.

5.3 Refunds. All payments are non-refundable, except where required by applicable law (e.g., EU consumer protection law provides a 14-day withdrawal right for digital services that have not been fully performed, provided you have not waived this right upon purchase).

5.4 Price Changes. We reserve the right to change subscription pricing. Existing subscribers will be notified at least 30 days before any price increase takes effect. Continued use after the price change constitutes acceptance of the new pricing.

6. Intellectual Property

6.1 Ownership. All content on the Service — including but not limited to music, audio recordings, videos, artwork, graphics, text, logos, trademarks, and software — is the exclusive property of Don Diablo, HEXAGON, or their respective licensors and is protected by international copyright, trademark, and intellectual property laws.

6.2 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. This license does not include the right to:

• Download, copy, reproduce, distribute, or share any exclusive music, audio, video, or other protected content from the Service.
• Record, screen-capture, rip, or otherwise extract audio or video content from the Service.
• Use any automated tools, bots, scrapers, or crawlers to access or collect content from the Service.
• Modify, adapt, reverse-engineer, or create derivative works based on any content from the Service.
• Use any content from the Service for commercial purposes, including but not limited to DJ sets, remixes, broadcasts, or public performances, without explicit written permission.

6.3 DMCA / Takedown. If you believe content on the Service infringes your copyright, please contact us at info@dondiablo.com with a detailed description of the alleged infringement.

7. User Content & Conduct

7.1 User Content. You may submit content to the Service through community features (e.g., Transmissions, Community Music, Letterbox). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content within the Service.

7.2 Prohibited Conduct. You agree not to:

• Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, or discriminatory.
• Impersonate Don Diablo, any artist, team member, or any other person or entity.
• Share or distribute invite codes for commercial gain.
• Spam, flood, or disrupt the community features.
• Attempt to gain unauthorized access to other users' accounts or any restricted areas of the Service.
• Use the Service to distribute malware, viruses, or any other harmful software.
• Violate any applicable local, national, or international law or regulation.
• Share, leak, or redistribute any exclusive or premium content outside the Service.

7.3 Enforcement. We reserve the right to remove any content and suspend or terminate any account that violates these Terms, without prior notice or liability. Decisions regarding content moderation and account enforcement are final.

8. Guestlist & Events

8.1 Availability. Guestlist spots offered through Hexagonia are allocated on a first come, first served basis and are subject to availability and venue capacity. Once all spots for a show are claimed, no further claims can be made regardless of membership status.

8.2 No Guarantee of Entry. Claiming a guestlist spot does not guarantee entry to the event. Entry remains subject to venue policies, local regulations, capacity limits, and the discretion of venue staff. We are not liable for denied entry for any reason.

8.3 Restrictions. Guestlist spots are personal and non-transferable. They may not be resold, traded, or given to third parties. We reserve the right to void any guestlist claim that has been transferred or misused.

8.4 Modifications. We reserve the right to modify, cancel, or restrict guestlist offerings at any time without prior notice. This includes changing the number of available spots, eligibility criteria, or the frequency of guestlist claims per member.

9. Third-Party Services

The Service may contain links to third-party websites and services (e.g., Spotify, Apple Music, YouTube, Stripe, ticketing platforms). We are not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is governed by their respective terms and policies.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DON DIABLO, HEXAGON, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100.00, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Don Diablo, HEXAGON, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.

13. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

If you are a consumer in the European Union, you may also be entitled to submit a dispute to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Service and supersede any prior agreements.
